Insurance companies and defense attorneys will always try to point to your pre-existing condition and say ìnow, this car accident didn’t cause it, you had it before. Your response is Well, I had it before, but this accident made it worse. Under Arizona law, if in fact you can prove that in the collision exacerbated your condition, then you will be entitled to recover for that pre-existing condition, to the extent it was made worse–just as though the accident had caused it in the first place.
